Terms and conditions

Canned Banners, LLC (hereafter referred to as "CannedBanners") grants the use of the CannedBanners web-based service (the "Service") to you based on the conditions listed on this page.

Authorized Use

You are authorized to use the Service to generate SWF files (SWF files generated using the CannedBanners service will hereafter be referred to as "Banners"), which will be emailed to you upon your completion of a transaction. You agree not to use or attempt to use the Service for any purpose which falls outside the creation of Banners in the format(s) provided by the Service.

You further agree not to program, design, or set up any computer, software, network, or server to automatically interact with CannedBanners. You agree not to execute batch commands against any CannedBanners service, application, database, or server. Use of the Service is restricted to real-time interaction between the Service and you, a human being.

Disclaimer of Warranty

CannedBanners provides its Service and Banners "as-is" and makes no warranty as to their effectiveness, suitability, proper functioning, or stability. You are responsible for testing your Banners and making sure they function properly and adhere to your standards.

The Content of Your Banners

It is your sole responsibility to manage and adhere to the rights of any creative assets (e.g., images, text, logos) appearing in Banners. CannedBanners is not responsible for images or other creative assets being improperly displayed in a Banner.

CannedBanners is not responsible for the content you customize in your Banners. Nor is CannedBanners responsible for any conflicts, lawsuits, claims, judgments, or misunderstandings arising from the customized content in your Banners.

Ownership

You have ownership of any Banners delivered to you and generated using the CannedBanners service. However:

  1. You may not sell or transfer Banners to any third party.
  2. Your use of any Banners shall be limited to your own or your company's own personal or commercial use. You may not create Banners for the benefit of any third party.
  3. You may not make Banners publicly available for download.
  4. You have no ownership claim to the FLA source template from which your Banner was derived. CannedBanners is under no obligation to deliver to you any FLA formatted content.
  5. Your ownership is contingent upon your adherence to the terms and conditions specified on this page.

Furthermore, CannedBanners is not responsible for the manner in which you use any Banners delivered to you. Once CannedBanners delivers a SWF file to you, it is your property. Any conflicts arising from your use of your Banners are your responsibility to resolve, and you agree to indemnify CannedBanners and hold CannedBanners harmless.

Privacy

CannedBanners will not provide your Banner or any customized content thereof to any third party without your prior written consent.
